Terms of Use
The terms that govern this website and the paid services you order through it.

By using this website or ordering services through our portal, you agree to these Terms of Use. If you do not agree, please do not use the site or our services.
About our services
Draco Investigative Services is a licensed private investigation practice that also operates as a consumer reporting agency (CRA). Reports we assemble for purposes covered by the federal Fair Credit Reporting Act (FCRA) — such as employment or tenant screening — are "consumer reports," and both we and you have responsibilities under the FCRA and applicable state consumer-reporting and private-investigator laws. Website content is general information about our services and is not legal advice.
Eligibility
You must be at least 18 and legally able to enter a contract. You may order a report only when you have a purpose permitted by law and, where required, the subject's authorization. Our services are offered in the United States (and, where noted, elsewhere in North America).
Accounts
You are responsible for providing accurate information, for keeping your password confidential, and for activity under your account. Tell us promptly if you believe your account has been compromised.
How an engagement is formed
A paid engagement is created when you accept these terms and complete payment through the portal (click-through acceptance) — a separately signed written agreement is not required to create the engagement. Submitting an inquiry through the public contact form does not create an engagement and does not obligate either of us. We reserve the right to decline or cancel any request, including one that appears unlawful or lacks a permissible purpose.
Fees & refunds
- Individual background check: a flat $99 fee, paid at the time you submit your request.
- Employer screening: $49 per employee for the standard package. Each screening is paid through Stripe's secure checkout at the time you submit it; if you have saved a card, it is available to select during that checkout. We do not charge a saved card without you completing a checkout. To remove a saved card or close your account, contact us and we will action it.
Fees pay for investigative and processing time and effort, not a particular result, and are non-refundable, including where the findings are not what you hoped or where no responsive records are located. Any additional services are quoted separately before they are performed.
Your certifications and obligations as a user
Each time you order a report, you certify and agree that:
- you have a permissible purpose under the FCRA for obtaining the report, and you will use it only for that purpose and for no other;
- for employment purposes, you have provided the applicant a clear, stand-alone disclosure and obtained the applicant's written authorization before the report is ordered, and you will comply with the FCRA's adverse-action requirements;
- you will not use any report, or any driving-record or financial information, in violation of the FCRA, the Driver's Privacy Protection Act, the Gramm-Leach-Bliley Act's prohibition on obtaining financial information by false pretenses, or other applicable law;
- you will not use our services to harass, stalk, intimidate, or unlawfully harm any person, or to make a decision the law prohibits.
These certifications are a condition of service. We maintain reasonable procedures to verify the identity of our users and the permissible purpose certified, and we may require additional verification before furnishing a report. Providing a false certification, or misusing a report, is a serious matter and may violate federal law.
Adverse action — your responsibility
When you take adverse action (for example, declining to hire or to rent) based in whole or part on a consumer report, the FCRA places the adverse-action obligations on you, the user — you must provide the required pre-adverse and adverse-action notices, including our name and contact information, a statement that we did not make the decision and cannot explain it, and notice of the consumer's right to a free copy of the report and to dispute its accuracy. We are not a party to your decision and do not send these notices for you; we provide our identifying information and reasonable support so you can meet these obligations.
Our commitments as a CRA
As a consumer reporting agency we are subject to the FCRA's requirements. We follow reasonable procedures to assure maximum possible accuracy of what we report; we provide the FCRA "Summary of Your Rights" and the "Notice to Users of Consumer Reports" on request; and we honor consumers' rights to obtain their file and to dispute information and obtain a reasonable reinvestigation, as described in our Privacy Policy. Where a report draws on motor-vehicle or financial information, we obtain it only for purposes permitted under the Driver's Privacy Protection Act and the Gramm-Leach-Bliley Act, and never through false pretenses. These are commitments to reasonable, lawful procedures — not a guarantee of a particular outcome or that every third-party source is error-free.
Sensitive information
Submit Social Security numbers, dates of birth, and similar sensitive identifiers only through the secure portal forms, which are encrypted and access-controlled — never through the public contact form or by email.
No guarantee of outcome
Investigations are undertaken with professional diligence, but the nature of investigative work means specific results cannot be guaranteed. Nothing on this site is a promise of a particular outcome.
Intellectual property
The content, design, logo, and marks on this website are the property of Draco Investigative Services and may not be copied or reused without permission.
Disclaimers & limitation of liability
The website and services are provided "as is." To the fullest extent permitted by law, we disclaim implied warranties and are not liable for indirect, incidental, or consequential damages arising from your use of, or inability to use, the website or services. Nothing in these terms limits or waives any liability that cannot be limited or waived under the FCRA or other applicable law, including a consumer reporting agency's statutory liability for negligent or willful noncompliance.
Indemnification
You agree to indemnify and hold us harmless from claims and losses arising out of your misuse of a report, your use of a report without a permissible purpose, a false certification, or your failure to meet your FCRA or other legal obligations.
Governing law
These terms are governed by the laws of the State of California, together with the federal FCRA and the consumer-reporting and investigator laws of the states in which services are provided.
Changes
We may update these terms from time to time; the "Last updated" date above reflects the current version.
